Section 137 of the Energy Policy Act of 2005 (Pub. L. 109-58) requires the Commission to conduct a rulemaking to examine the effectiveness of current energy efficiency labeling requirements for consumer products covered by the Energy Policy and Conservation Act. The Commission has completed the required rulemaking and is publishing final amendments to the Appliance Labeling Rule (16 CFR Part 305).

The FTC announces new ranges of comparability for compact clothes washers, refrigerators, refrigerator-freezers, and freezers. In addition, the Commission announces that ranges of comparability for standard clothes washers will remain in effect until further notice. Finally, the Commission is issuing minor, technical amendments to update the definition of medium base compact fluorescent lamp and to correct a sample heat pump label in the Rule.

The Commission has approved the publication of an advance notice of proposed rulemaking in the Federal Register to examine the effectiveness of the FTC’s Appliance Labeling Rule (16 C.F.R. Part 305). As directed by Section 137 of the Energy Policy Act of 2005, the FTC has initiated this rulemaking to consider the effectiveness of the consumer products labeling program in assisting consumers in making purchasing decisions and improving energy efficiency. The Commission is seeking comments on a broad range of issues, including the design and content of the current EnergyGuide label and possible alternative label designs.

The Federal Trade Commission grants manufacturers of residential
appliances covered by its Appliance Labeling Rule a conditional
exemption from the Rule’s prohibition against the inclusion
of non-required information on the EnergyGuide labels required
by the Rule. The exemption enables appliance manufacturers
to place the logo of the Department of Energy’s and
Environmental Protection Agency’s joint "ENERGY
STAR" Program on required EnergyGuides on some appliances
under certain conditions. The Commission also announces a
non-substantive amendment to the Rule to include "Federal
Trade Commission" in the text at the very bottom of all
EnergyGuide labels so consumers and others will be clear as
to the identity of the agency with the authority to enforce
the Rule.

Labeling Rule to eliminate the "Front-Loading" and
"Top-Loading" sub-categories for clothes washers.
The purpose of this change is to provide consumers with a
more accurate basis to compare the efficiency of clothes washers.
