The Commission has received an application from America Online/Time Warner, Inc. (AOLTW) requesting approval of a non-affiliated Internet Service Provider (ISP) and alternative cable broadband service agreement. Pursuant to Paragraph II.A.2 of the decision and order finalized by the Commission on April 17, 2001, concerning AOL's acquisition of Time Warner, Inc., AOLTW has requested FTC approval of: 1) Internet Nebraska Corp. (Internet Nebraska), a non-affiliated ISP; and 2) the alternative cable broadband ISP service agreement entered into between Time Warner Cable (TWC) and Internet Nebraska to provide ISP service in TWC's "Nebraska division."
The FTC is accepting public comments on the proposed application until March 15, 2002. Commission approval of final consent orders:
Following a public comment period, the Commission has approved final consent orders in the matters concerning Pharmaceutical Formulation, Inc.; LNK International, Inc.; Leiner Health Products, Inc; A&S Pharmaceutical Corp., and Perrigo Company. Following a public comment period, the Commission has approved a final consent order in the matter concerning Valero Energy Corporation (Valero) and Ultramar Diamond Shamrock Corporation (Ultramar). The vote to approve the final consent order was 4-0, with Chairman Timothy J. Muris not participating.
