Sharolyn Smidt Glycohealth International June 10, 2005 Federal Trade Commission/Office of the Secretary, Rm H-135 (Annex W) Re: Business Opportunity Rule, R511993 600 Pennsylvania Ave, NW Washington, DC 20580 RE: Business Opportunity Rule, R511993 Dear Sir or Madam: I am writing this letter because I am concerned about the proposed Business Opportunity Rule R511993. I believe that in its present form, it could prevent me from continuing as a Mannatech Incorporated Associate who distributes products directly ordered from the company. I understand that part of the FTC's responsibilities is to protect the public from "unfair and deceptive acts or practices", but some of the sections in the proposed rule will make it very difficult if not impossible for me to sell Mannatech's products. The seven day waiting period to enroll new associates in Mannatech is objectionable. The introductory sales kits only cost $39! People buy TVs and cars and other things that cost much more and do not have to wait seven days. This waiting period implies that there is something wrong with the sales plan. Also, Mannatech already has a 90% buyback policy for all products including sales kits purchased within the last twelve months. The record keeping that will result from passage of the rule will cause a paperwork nightmare for me and Mannatech. You know anyone can be sued for anything. I don't want to have to discuss any lawsuits that seem ridiculous to me before I can enroll someone in Mannatech. Some politically motivated lawsuits against Mannatech are pending that have nothing to do with me or the results of the products. The proposed rule to disclose ten prior purchasers is nuts!! Think of the confidentiality issue in doing this not only for my customers, but for Mannatech to keep track of in order to make it safe from identity theft. I have been in Mannatech using and sharing the products for 9 years. They are awesome products and I enjoy the added income I get from a home based business. The FTC is working for me and I hope you will see why this rule will create a huge burden for my family and colleagues if implemented. In this day and age, we need to be responsible for our own health and wealth and I wish for you to help me in this by not passing this ruling. Thanks. Sincerely, Sharolyn Smidt
