Federal Trade Commission/ Office of the Secretary, Room H-135(Annex W) Re: Business Opportunity Rule, R511993 Dear Sir or Madam: I am writing this letter because of my concern about the proposed Business Opportunity Rule R 511993. I believe that in its present form it could prevent me from continuing as a Distributor and destroy my small business. I have been an Independent Contractor for the last 2 years, since my disability prevents me from working in the public arena I am unable to find work. Taking my wife’s urgent medical issues into consideration (almost daily Dr. visits) I don’t believe any employer would want an employee taking so much time off. With utility/gas costs rising at astronomical rates, medical costs rising in double digit percentages jobs being exported, machines reducing required man-hours,. immigrants (legal and illegal) coming into our country. It really is quite a burden with social security rising at a mere 2 % and a cap on disability earnings for those of us who have been disabled for any length of time. As a user of this product, it has a lot of science behind it, by the National Library of Science an Medicine http://www.ncbi.nlm.nih.gov/entrez/query.fcgi?DB=pubmed I have gotten remarkable results in relieving my arthritis pain, eczema, tennis elbow, cuts, I don’t burse as easily as I once did, my energy levels have increased, it is making my Parkinsonism less severe, helps relieve my depression, gum disease, allergies, vertigo, aches and pains including dental pain, it’s anti-inflammatory, Anti-ulcer (for example, ulcers of stomach, mouth, small bowel, large bowel) anti-fungal. Not to mention the things it does you cant see like reduce blood pressure and cholesterol. Originally, I started my Network Marketing because of the product I love it, it is one of the very few with the integrity not only in health benefits but with the pay plan. My family depends on this extra income to supplement our budget. Please don’t destroy my small business we need it! Some of the sections in the proposed rule would make it hard or almost impossible for me to sell my product. One of the most difficult sections of the proposed rule is the seven day waiting period to enroll a new distributor. This waiting period will give the public the idea that there’s something wrong with me or our plan and also reflects badly on me. I also think this seven-day waiting period is unnecessary, because Xango already has a 90% buyback policy for all products including sales kits purchased by a salesperson. It is my goal to throw people a lifeline into the sea of health issues (no side effects or warning labels) and financial issues which often lead to bankruptcy. This company has the science and integrity to back up its claims. Xango’s membership only costs $35.00. People buy TVs, cars, and other items that cost much more than that and they don’t have to wait seven-days. Under this waiting period requirement, I will need to keep very detailed records when I first speak to someone a prospect and will then have to send in reports to my company. I am a small home business and this burden hurt or destroy my business. This proposed rule is bad Finally, the proposed rule requires the disclosure of a minimum of 10 prior purchasers nearest to the prospective purchaser. I am glad to provide references, but in this day of identity theft, I am very uncomfortable giving out the personal information of individuals (without their approval) to strangers. Women in my organization may be subject to sexual or racial harassment so this part can’t go in at all, unless the FTC passes an addition to this rule Prohibiting sexual or racial attacks related to this disclosure. In the end the rule must bind the FTC to take direct enforcement action on sexual and racial attacks with a special unit assigned to monitor actions related to the disclosure forms. I have seen many scams on the Internet and been approached by many crooks because of my success
