FTC: Notice of proposed rulemaking Subj: Business Opportunity Rule CFR Citation: 16 CFR Part 437 Dear FTC, Right up front, this is a bad rule to impliment; it will only hurt the good and honest people in the direct sales and network marking industries who are trying to make a living! 1. A seven day waiting period: Wow, never heard of such a thing; who wouldn't lose interest in that length of time? It would be great if car dealers, retail stores. in-home sales, etc had to wait a whole 7 days or maybe try out their product for 7 days before I had to buy it! It seems to me that it would be an administrative nightmare to try to comply with this, not only for the company but for those who are self employed for a company. Question: Why do you feel any fraudulent company or organization would ever comply with this rule? In fact, this will help not hurt them. The only people this will hurt are the honest companies and people just trying to improve their lot in life. 2. Providing lists to Government 10 previous who joined and people who enroll and cancel in an organization: Who does this benefit? How does this reduce crime? How in the world does this help good people? Isn't government encroaching into our lives way too much? It seems to me you don't want anyone to be in network marketing or you want to make a gov't list of all people for what purposes? Can't be good. The record keeping required to comply with these rules would drive the average person out of this industry. It is complicated, very time consuming, cumbersome and if they ever complied with the rule would bury you with paper. Most of us would not want to give that information out: What ever happened Right to Privacy? Further, it may sound hokey, I feel I would have a moral and ethical obligation to my fellow US citizen not to comply. It is in violation of my constitutional rights!!! When will it end? When will government quit trying to catch criminals at the expense of good people and companies? As far as the other rules I don't see them being effective, no one likes gross claims about income or how easy it the business is,however, I don't see this having any impact on the crooks. I can hear their line now " well no mamm, we wouldn't lie about this, in fact, thats against the law: we would not do anything against the law right?" and so on - they will have a hayday! In conclusion, I do not believe these rule changes will have any positive impact on reducing crime and fraud or in catching crooks. It will have a huge negative impact on those companies and people in the direct sales and networking industries. It will cause thousands, if not millions of people to quit, not get involved and leave the network marketing and direct sales industries.. I don't believe this is what you wanted, least I hope not!!
