Re: CAN-SPAM Act Rulemaking, Project No. R411008To the Commissioners,Yes, your efforts to curb the problem ofunsolicited bulk email are reasonable. Unfortunately a growing number of true business owners on the Internet, and there are hudreds of 1,000's of us, are concerned about the proposed requirement for merchants to maintain suppression lists.Like many of your laws, they punish the good people, more than help them.Requirement of the use of suppression lists willseriously damage many of the legitimate publications available on the net. And there are hundreds of 1,000's. Our specific concern is for harm to publishers who require permission from the consumer prior to adding them to any list.They're not who CAN-SPAM was designed to put out of business, but this requirement will very likely have that effect.There's also the potential for significant harm toconsumers, because of the problem of properly knowing their intent when they unsubscribe from a list. On top of that, suppression lists could easily fall into the hands of spammers, leading to more spam instead of less.[LEAVE THIS MATTER IN THE HANDS OF THE PEOPLE (TO GOVERN THEMSELVES - WE CAN YOU KNOW) AND SPAMMERS WILL FIND THEIR EFFORTS FUTILE VERY SOON.]I was quite surprised at the potential problems thisruling could involve, and urge you in the strongestpossible terms to reconsider its implementation in light of these problems,Concerned about your laws,Bart SmithCosta Mesa, CA / America
