Re: CAN-SPAM Act Rulemaking, Project No. R411008To the Commissioners,Your efforts to fight the problem of spam, unsolicited junk email is to be commended. I do have one concern, though, and that is proposed requirement that merchants must maintain suppression lists.This requirement will cause a lot of problems and additional costs that will cause unprecedented damage to legitimate email marketers. I urge you to consider this most seriously. If you require all of the email marketers to abide by this requirement, it will cause tremendous damage to the legitimate email marketers and email publishers. The legitimate publishers and marketers require prior permission from their customers before adding them to their lists.Even though these marketers are not the ones who the CAN-SPAM law was designed to force out of business, this requirement will have that effect.There's also the potential for significant harm to consumers, because of the problem of properly knowing their intent when they unsubscribe from a list. On top of that, these suppression lists could easily fall into the hands of spammers, leading to more spam instead of less.I was quite surprised at the potential problems this ruling could involve, and urge you in the strongest possible terms to reconsider its implementation in light of these problems,Respectfully,Mel Waxman Florida, USA
