The CAN-SPAM Act takes the wrong approach.All commercial email should be banned unless the recipient specifically opts-in. This should be verified with a follow up confirming email with the option to opt out at any time. Opt out options should be available by several means of communication. i.e. Currently, some emails require that the recipient mail them notice via US Postal Service to be removed.
