You worry about the interpretation of the words "primary purpose" yet your first two proposed definitions include the words "more important" which I think are also open to interpretation and therefore you should not use them. In my opinion a commercial electronic email message is an email that is "engaged in commerce with the chief emphasis on selling or advertising a product or business". This is just basically a definition of commercial and I think allows anyone to correctly identify a commercial email.
