E.1.2 Both advertising company and sender should be held liable regardless of who received the opt-out. If it can be proven that the advertising company notified the sender of an opt-out, the advertising company should be free from liability. E.2.6, E.2.7. Original sender should be held liable if it promoted the forwarding of a message, resulting in gain to the resender.
