Spammers are extremely adept at gaming both the technology and regulations to send unwanted commercial email, or spam. I view any options susceptible of being gamed as a bad. The regs should be AIR TIGHT. Let me be 100% clear -- given a choice between diminishing spam and missing some legitimate communications from companies I already do business with, I strongly choose the greatest possible protection from spam, no matter the extent of so called "legitimate" emails I'd miss from companies I already do business with. Missing ALL "legitimate" emails from companies I already do business with would be FINE if it meant I'd avoid some or all spam. In my view as a citizen, the privacy of my email should be held EQUAL to the privacy of my phone line(s). This is based on personal impact. For instance, I pay MORE monthly for my internet access than I do for phone service, and the time I spend daily on dealing with email is usually GREATER than that I spend on dealing with phone communications. The regulations must be written and enforced vigorously enough to provide equal protection with the no-call list. Most importantly, the establishement of a "relationship" between me and an internet business must include an actual commercial transaction. In no case should the "registration' often required to view informational web sites be considered a "relationship" for purposes of your act. A good way to help this along would be to require that the type in which a company puts any you-agree-to-let-us-spam-you language must be equal in size and clarity to the largest clickable link on their site, instead of burried in 7 point type at the end of some legalese that would take 30 minutes to read and of course nobody does, which is just what they want) A type face requirement is what I call measureable!
