CAN-SPAM is largely inneffectual as it has been written. It needs to be updated in these ways: Any email sent with an unsolicited commercial message should be considered spam. CAN-SPAM effectively legalized SPAM by not requiring opt-in. For CAN-SPAM is to be effective, it needs to updated to make it illegal to send commercial messages without customers first opting-in. Exceptions for political advertising or any other types of communications should not be made.
