April 13, 2004 Re: CAN-SPAM Act Rulemaking, Project No. R411008 To the FTC Commissioners, It’s great you’re trying to curb the problem of unsolicited bulk email. However, I’m worried about your proposed requirement for merchants to maintain suppression lists. Before you implement this, please consider the impacts and costs very carefully. They are many potential detrimental effects. These include: • Legitimate publications that require permission from the consumer prior to adding them to any list will be unnecessarily burdened. • Discriminating the intent of subscribers when they unsubscribe from a list. • Suppression lists could easily fall into the hands of spammers fro their nefarious uses It shocked me the potential problems this ruling could involve.
