Re: CAN-SPAM Act Rulemaking, Project No. R411008 Dear Commissioners, It's great to get rid of SPAM. However, I am concerned about the proposed requirement for merchants to maintain suppression lists. As a business owner that emails to our own opt-in subscribers...one that provides a way for people to opt themselves in or out...the prospect of the many problems and costs associated with maintaining such a list seems daunting. My specific concern is for harm to publishers who require permission from the consumer prior to adding them to any list. They're not who CAN-SPAM was designed to put out of business, but this requirement will very likely have that effect. We, in good faith, do our utmost to provide every means for people to be able to opt out and we manually remove them as needed...however glitches do occur sometimes and it would be rough to be found in violation and have to face all manner of penalties...and we're not the smallest of retailers either...how much harder would it be for honest people just starting out. There's also the potential for significant harm to consumers, because of the problem of properly knowing their intent when they unsubscribe from a list. On top of that, these suppression lists could easily fall into the hands of spammers, leading to more spam instead of less. I want to be able to keep our customers informed...and as a customer of other businesses, I want to be kept informed of what offerings they have. Buying and selling is the basis of our economy and it is the means that we use to share our skills with one another that we may all benefit one another. I think we should make it as easy as possible for people to conduct good faith, honest business or trade....that we all may prosper and progress. It's basic and vital and a big reason why our country is so prosperous and advanced compared to other countries.
