Re: CAN-SPAM Act Rulemaking, Project No. R411008 To the Commissioners, This is to register my vehement opposition to the proposed requirements for merchants to maintain email suppression lists! While I applaud your efforts to curb the problem of unsolicited bulk email, this measure goes to far. There are so many problems and costs associated with this idea, and so much damage done to consumers and businesses alike, that I feel I must urge you to reconsider this matter. In my opinion, the primary issue is that when spammers send their email, attempts to return email to opt out cannot be sent (they "bounce back") and there is no way for consumers who are targeted by these people to identify them. The new legislation should require that a valid return email be included in each marketing email sent so that only those who desire to remain on the mailing list are emailed subsequently. If you require all merchants to use suppression lists, it will seriously damage many of the legitimate publications available on the web. My specific concern is for harm to legitimate businesses who require permission from the consumer prior to adding them to any list. They're not the group that CAN-SPAM was designed to put out of business, but this requirement will very likely have that effect. There's also the potential for significant harm to consumers, because of the problem of properly knowing their intent when they unsubscribe from a list. On top of that, these suppression lists could easily fall into the hands of spammers, leading to more spam instead of less. Please discontinue this approach to limiting spam!
