Re: CAN-SPAM Act Rulemaking, Project No. R411008 Dear commissioners, Trying to be objective concerning this contentious issue, I would beg you to stand back and allow the manipulative cries and panic to subside, and to set aside the bulk of this draconian law. The most that should be outlawed is 'denial of service attacks' and their ilk, cheating, and 'spoofing' of senders' addresses, and not providing a clear, simple and speedy 'opt-out' option. One global federal regulation better serves everyone than 50, whereupon one ill conceived law becomes the defacto law of the land (Virginia, California). Once selected, the opt-out option should be completed within minutes, not days, or at the very least, as soon as the 'offending' senders' email server comes back online. This means no more email whatsoever since the opt-out command must be first in line for completion before any further contact. It is automatic, just as are the emails, therefore no need for a delay of days. Just allow room for honest hardware glitches. Suppression lists would become an instant pyramiding and unmanageable boondoggle. It would be a cancer on peoples' right to communicate, on their freedom of speach, on their ability to conduct business! The commission must also consider the legality of 'spamcop' and 'Norton code blockers' and their brethren as illegal trampling of a company's right to conduct legitimate business. As it is, the law will effectively hinder only law-abiding people who already try to self regulate their own internet conduct. Please put this law in a fair and balanced context by curbing the glaring trespasses I have mentionned above. Then decide to wait some months longer while encouraging the delivery of software to all and sundry that will filter out 99+% of spam by the simple expedient of killing any missive that arrives via a 'spoofed' or unmatched 'from-address'. This is a simple, elegent solution that may already be available: Spam Terminator by Secure Technologies International may be just such a device that filters out the junk without touching wanted email. I am unsure however as I don't own a copy and I don't like their bloated $36 a year 'matrix' sales method. Regardless of the current volume of email traffic, the claimed high cost of spam is a red herring hollered to leverage action by the government, while a simple elegant 'no muss no fuss' solution is do-able immediately, and would cut unwanted traffic and 'costs' by 99% as soon as all users make the tiny effort to find (google search) and install it on their PCs. Your military intelligence agencies and the NSA can provide clear and immediate definition of just what simple tool is needed. There is no need for such a draconian law as CAN-SPAM is now conceived. In conclusion; Please encourage people to find the simple solution that is already available or at least do-able. Please resist eroding the First Amendment.
