Re: CAN-SPAM Act Rulemaking, Project No. R411008 To the Commissioners, Please Help I do thank you for trying to clean up this horrible spam mess that every person who uses a computer faces. I must however express my sincere concern with this current 'CAN-SPAM' Act regarding the use of suppression lists. I run a legitimate business and only ever communicate with the people who have asked to receive my information. This information genuinely helps them in their lives, and my customers have total and complete control over whether they would like to receive communication from myself. This communication is also a large part of customer service which unfortunately is lacking these days. I myself have also asked to receive to receive communication from people who have legitimately Helped me in my personal growth. Communication of which I would be lost without. With these newly proposed laws, my customers will suffer. I will suffer, legitimate businesses will suffer -- and what you are proposing will cause undue hardship for so many innocent people who will lose their livelihoods as a result of this act. I beg you, please, please don't enforce these potentially hurt-full laws. The only way to solve this horrible problem is to enforce the laws we've already got... I still get over 2,000!!! SPAM emails in my email box every single week which at times has nearly bought me to tears trying to deal with it all. To make it worse, these horrible people hide behind fake email addresses/postal addresses & phone numbers and will not let you unsubscribe from their lists, no matter how hard you try. Then they re-sell your email address to another spammer. It's a horrible cycle, and I believe this is where the problem lies - with these inconsiderate & dishonest 'spammers'. In regards to Who should be required to provide an “opt-out” mechanism for such a message? The person who sent the email. The problem is with thoser people who buy CDs 9"1 million names for $50" and the like) of people's email addresses that have been 'sold' or harvested without the knowledge of the person who owns the email address. This duplication causes hardship and massive spam for everyone. People who have legitimately received permission to send messages to customers / friends should not have to suffer due to the acts of the Spammers. As long as someone has permission to use their email address from the person who is aking for more information on a topic and provides an easy and quick way for the recipient to unsubscribe.
