Re: CAN-SPAM Act Rulemaking, Project No. R411008 Gentlemen: I applaud your efforts to curb the problem of unsolicited bulk email. However, I am deeply concerned about the proposed requirement for merchants to maintain suppression lists. This idea is fraught with problems and costs that will cause serious economic damage both to consumers and businesses alike. I must urge you to consider this matter most carefully. My specific concern is for harm to publishers, like myself, who require permission from the consumer prior to adding them to any list and who market our materials through affiliates, who we also require to obtain consumer permission. We are not who CAN-SPAM was designed to put out of business, but this requirement will very likely have that result. It would, in effect, require me, and others like me, to be responsible for ensuring that all of my affiliates, who are independent business people, maintain management records of their mailing lists. I have no idea how I would even begin to approach doing this and likely would be forced to sever the relationship with all of my affiliates. That would mean substantial loss of income for me. In addition, these suppression lists could easily fall into the hands of spammers, leading to more spam instead of less. I am very concerned about the potential for creating complex problems that this ruling could involve, and urge you in the strongest possible terms to reconsider its implementation.
