Re: CAN-SPAM Act Rulemaking, Project No. R411008 To the Commissioners, I support the suppression of unsolicited bulk email. However, I believe this proposed Act will not solve the problem, but will only stifle legitimate online business. The damage that will be done to both consumers and legitimate online businesses by this proposed Act is quite appalling. I believe that by requiring the use of suppression lists, the proposed Act will seriously damage many legitimate publications available online. My specific concern is for harm to publishers who require permission from the consumer prior to adding them to their list. They're not who CAN-SPAM was designed to put out of business, but this requirement will very likely have that effect. Consumers will be harmed very often, as it won't be clear whether they have intended to unsubscribe from a list or not. Also, spammers will probably get their hands on these proposed "suppression lists", and you know what will happen then, don't you? If this Act is implemented it will do untold damage to free enterprise and put many legitimate online businesses out of business, whilst doing nothing to stop or stem the flow of unsolicited commercial junk email.
