Re: CAN-SPAM Act Rulemaking, Project No. R411008 To the Commissioners, I agree with your efforts to curb the problem of unsolicited bulk email. However, I am concerned about the proposed requirement for me to maintain suppression lists. If I were to maintain a list of my customers who have opted out of my E-mail marketing campaigns, then I would not be fulfilling the customers wish because someone else might be able to acquire that list without my express permission or knowledge. When a customer opts out of my list, their E-mail address is removed, period. E-mail marketing is one of my most cost effective means of notifying my customers about new products and sales. The customers who receive this information have given me permission to send it. I won't mitigate their trust by sending their information, whether subscribed or un-subscribed, to anyone else, including the government. I was quite surprised at the potential problems this ruling could involve, and urge you in the strongest possible terms to reconsider its implementation in light of these problems, Respectfully, Ken Ewald San Antonio, TX, USA
