Re: CAN-SPAM Act Rulemaking, Project No. R41100 Dear Sirs, I appreciate the intentions that you have in seeking to stop spam email, and have a deep concern that in the process that the innocent will be persecuted and have their businesses damaged in the process through using suppression lists. My concers are that it is going to be costly and the damage that will be done to consumers and businesses alike, who mutually wish to share their information and correspons to each other both through a Newsletter, E-zine and/or private correspondence. This really appears to be taking away the rights of people through free choice to correspond and recieve requested information at will. The use of suppression lists will damage these relationships and to many they are and can be a form of life support of information that they require. There are many opt in lists for legitimate publications on the web that will be greatly harmed. People have freely chosen to be mailed to and have a free choice to be automatically unsubscribed if they choose not to recieve the newsletters or publications. If this form of suppression is implimented there will be no end to the posibilities of suppression of people who wish to recieve Readers Digest or Time Magazine or whatever till now they have had the free choice to receive. I understand that the above scenarios are not who CAN-SPAM was designed to put out of business and bring to a halt, but this requirement will very likely have that effect. There's also the potential for significant harm to consumers, because of the problem of properly knowing their intent when they unsubscribe from a list. On top of that, these suppression lists could easily fall into the hands of spammers, leading to more spam instead of less. I am very concerned that these rulings could affect my business and the businesses and consumers of countless millions worldwide who legitimately supply information to clients who wish to be on a mailing list. This ruling has a lot of potential problems. May I please implore you to very carefully reconsider what this could mean to many people and businesses who do not wish to live under any form of communism but enjoy the respected freedoms of our western society. Again I appreciate that this is aimed at the Spammers who ought in deed to be targeted with a high powered rifle rather than a shot gun where many innocents are harmed.
