Re: CAN-SPAM Act Rulemaking, Project No. R411008 To the Commissioners, Whilst I appreciate the efforts of Authorities to eliminate the problem of unsolicited bulk email, I am concerned about the proposals being put forward that require vendors/merchants to use 'suppression lists'. It appears that every effort that is made to thwart the 'SPAMMERS' of this world only results in more costs and problems for legitimate businesses and also inconveniences for 'willing' customers who make valid requests for products/services/information and don't receive them because of 'enforced' email filters or in this case, supression lists and rules. The very villain that all these efforts are meant to get rid of are still able to 'hammer' out their messages each and every day. The requirement of the use of suppression lists will seriously undermine the viability of many valid and valuable publications that are available on the net. These publishers who require permission from the consumer prior to adding them to any list will end up being the victims even though they are NOT the ones that the CAN-SPAM act were designed to remove. In fact these suppression lists could easily fall into the hands of spammers, leading to more spam instead of less. These sorts of lists are GOLD to a SPAMMER because they have no conscience when it comes to the act of SPAM. The legitimate small business operator will find this type of legislation because unwielding and, cost of compliance and ensuring unsubscription requests are adhered to by all other parties increases costs and is unbelievably complicated. Equally as important is the net effect on valid requests from consumers/customers for inclusion/exclusion on a list that may go ignored because their intentions are not clearly identifiable. I feel I must urge you to consider this matter most carefully. Please consider the affect on law abiding citizens of the world who go about their daily business and who are constantly bombarded with more and more legislation whilst the real villains are NOT AFFECTED IN ANY WAY. I live in Australia where normal every day business rules and taxation laws place undue burdens on reporting business activity where every detail of your business activity is scrutinized - again the only people this effects through extra costs and administrative duties are the HONEST business person. Most dishonest business people don't comply with Government regulations and thumb their noses at authority. I do hope common sense will prevail and that you realize that the complications and costs of this legislation will only affect the valid, honest business owner and consumers alike who enjoy the freedom to transact both business and personal affairs using the conveniences and the advantages of the Internet. I put myself in both categories of valid, honest business owner and a consumer and I can see the problem of over this regulation from both points of view and it SCARES me!
