Re: CAN-SPAM Act Rulemaking, Project No. R411008 To the Commissioners, As an online businessman, I fully support your efforts to curb SPAM. However, I am concerned about the proposed requirement for merchants to maintain suppression lists. It's difficult enough to make sales online, without making the process any harder for both consumers and businesses alike. I would ask you to consider this matter most carefully. I dislike SPAM as much as anyone, and run my business in full compliance of the CAN SPAM act. Requirement of the use of suppression lists will prohibit many solid but small businesses such as mine to operate on the net. My biggest concern is for publishers who require permission from the consumer prior to adding them to any list. I already use double optin security to insure their permission. While not intended to harm either the consumer or the legitimate publisher, I feel the suppression list requirement will do just that. While we are not who CAN-SPAM was designed to put out of business, this requirement will very likely have that effect. Spammers always have, and always will, find a way to manipulate and twist the laws that apply, and use any means to maintain their unscrupulous actions. This new requirement will be ignored and walked on by them, while we, as honorable businessmen, will be forced out of business. After learning this, I was quite surprised at the potential problems this ruling could involve, and urge you in the strongest possible terms to reconsider its implementation in light of these problems, Sincerely, Kevin Wagner Bear River, Nova Scotia, Canada
