Re: CAN-SPAM Act Rulemaking, Project No. R411008 To the Commissioners, I greatly appreciate your attempt to curb spam. I myself have been getting 1000-2000 spam e-mails a day. However, I feel your proposed requirement for merchants to maintain suppression lists will punish legitimate businesses placing excessive burden on them while spammers continue to have free reign. Since the CAN-SPAM act was enacted I have seen many legitimate businesses taking measures to make sure they comply with the act, yet I do not receive any less spam whatsoever. The result has been that legitimate businesses have changed their behavior and I respect them for that, but it is obviously business as usual for massive spam-pushing companies (and individuals). The present proposal will only place more burden on legitimate online marketers. I have no reason to think spammers will change their behavior. If the present proposal is approved, I predict many online businesses will be out of business completely or at the very least cease to do business on the internet (hurting the U.S. economy since many are U.S. companies). I rely on online businesses to introduce to me to tools and products which will be useful to me in my life, and I welcome information on products that I have opted in to receive. I do not agree with merchants having to make any part of their their mailing list (or suppression list) available to any other company. I feel it is an invasion of my privacy as a consumer and it will make people who opt-out subject to even more spam. I believe it is my duty to opt-out of each list I want to opt out of (when I opted in in the first place) rather placing this burden on businesses. This proposal presents a potential nightmare for businesses and consumers alike while potentially creating a bigger playground for spammers. I urge and plead with you not to put it into effect.
