Re: CAN-SPAM Act Rulemaking, Project No. R411008 To the Commissioners, I applaud your efforts to curb the problem of unsolicited bulk email. However, I am concerned about how complicated the regulations are and the subsequent potential for misunderstanding and uneven enforcement. First of all, these regulations will only impace legitimate businesses in the US jusidictions. All of the "shady" businessess and those overseas will be beyond it's reach. That is the source of much of this kind of email now and in the future. A better approach would be to require valid sending email addresses on all commercial email. I even get junk email now that is addressed from myself. The proposed regulations would require me to prove that this email did not come from me - in essence making me presumed guilty which is the reverse of our basic freedoms. In addition the proposed requirement for merchants to maintain suppression lists is burdensome and fraught with potential abuse. There's also the potential for significant harm to consumers, because of the problem of properly knowing their intent when they unsubscribe from a list. On top of that, these suppression lists could easily fall into the hands of spammers, leading to more spam instead of less. I am as unhappy with the deluge of sickening email as you but since regulations start to take on their own life in spite of their original intentions I urge you in the strongest possible terms to reconsider its implementation in light of these problems, Respectfully, Robert Lambe Marcy, NY
