Re: CAN-SPAM Act Rulemaking, Project No. R411008 To the Commissioners, I acknowledge your efforts to curb the problem of Non-Solicited bulk email. I have two email accounts, the one at Yahoo has always received Non-Solicited ads that go directly into my bulk email... and that... I delete once a week! The other account is where I get email for my business, where I communicate with friends and partners, etc... Very rarely do I get Non-Solicited ads in this acct. My concern with the proposed requirement for merchants to maintain suppression lists is, that you will put people, like me, out of business! I am a work -at -home mom, the owner of a small business, which is slowly, but steadily growing. The emails that I send out, are in effect, continuing conversations with people that have inquired about having their own home-based business. These people came to me through a list of leads, leads that were only sent to me. During our conversation, if they don't see a fit for themselves in what I am doing and they ask to be deleted , I delete them! I know that other internet network marketer's also do business this way too.... I urge you to consider this matter most carefully, as there are so many problems and costs associated with the regulations of this Can-Spam Act. Costs that will cause a hardship for small business owners like myself. Requirement of the use of suppression lists will seriously damage many of the legitimate publications available on the net. My specific concern is for harm to publishers, of whom I am one, who require permission from the consumer prior to adding them to any list. We are not who CAN-SPAM was designed to put out of business, but this requirement will very likely have that effect. There's also the potential for significant harm to consumers, because of the problem of properly knowing their intent when they unsubscribe from a list. On top of that, these suppression lists could easily fall into the hands of spammers, leading to more spam instead of less.
