The opt-in or opt-out aspects in the regulatory system are abused. Just because a commercial sender proclaims someone has opted in to their list does not make it true. To avoid proliferation of unsolicited commercial email, one must not click on the opt-out feature or else the sender will know they have reached a valid address and sell it or bombard it with many more e-mails. Even when one does opt out the request is seldom honored.
