Notwithstanding current practice, I am not at all sure that it is fair in all cases to require payment of a decedent's debts even out of his estate. I know of several instances of deadbeat dads who are estranged from their adult children but have run up credit card bills. Why should these children, who were deprived of resources to which they were morally and legally entitled during their formative years, be obligated to discharge Dad's debts out of his modest estate? Until this situation is addressed, I favor any proposal which limits the abilities of creditors to collect debts from the estates of decedents.
