Facial recognition technology is already being abused in the public sector. Because of facebook and googling cataloging their customer's faces, third party phone apps such as Recognizr allow stalkers and criminals free access to strangers' personal information. If I was exploited by a criminal using facial recogniton to gain access to my facebook account, I would definitely sue Facebook. Facebook can only claim that this service meagerly aids tagging friends' pictures, an already sensitive social practice which many choose not to partake in; or at least would rather choose which pictures to tag rather than have a program automatically announce your every photographed action to the world. The corporate, marketing-driven cataloging of faces is an infringment of consumer freedom, an abuse of privacy, an invalidation of choice, and most importantly, an enormous risk.
