The rule applies to a Notary offering in-person identity proofing for enrollment. As a third party service provider, the Notary could be contracted to: collect or confirm biographical information; collect and transmit biometrics data; provide and explain privacy notices; and, hand deliver authentication tokens/ smart cards.
