COMMENTS ON PROPOSED RULES, REGULATIONS OR AGENCY ACTIONS:
A consent order is usually an order that is negotiated by the parties and represents a negotiated settlement. The proposed order lambasts Motorola for conduct that was probably not clearly against the law at the time that it occurred. I agree with Commissioner Rosch as his analysis is well stated. I am curious as to what impact that this consent order will have on Motorola, Google and the licensing of standard essential patents (``SEPs'') for cellular, video codec, and wireless LAN standards. Also, it would appear that this litigation is second guessing previous court rulings in patent cases filed by Motorola.
Is this consent order really going to help competition and is this selective prosecution?
