The biggest problem is judges. The law is already there. But judges view the case through their equity lens and weigh it on a case by case basis. They view the case as any other contract case and apply a business to business rubric. I don't think the laws need shoring up so much as there needs to be a STRONG policy statement and a direct roadmap for judges to follow in these types of cases.
