I am opposed to the creation of a seperate safe harbor list, because it will simply cause confusion on the part of the consumer. Many seeking complete relief from obnoxious telemarketing calls will mistakenly sign up for this second list, thinking they are now protected - only to find that they still get telemarketing calls. Policing this list for violations by businesses that have no direct "first- hand" business dealings with consumers (but perhaps do have second or third-hand order fulfillment relationships) would be extremely difficult.
