I read about the following proposal http://www.ftc.gov/os/2006/10/R411001telemarketingruleFRN.pdf While I agree that spam should be banned, the wording of your text does more than that. Acceptance of services via email or a webpage should be allowed. Another possibilty is to allow the use as long as an opt out option is presented and honoured. I think the real problem is that a mechanism for receiving complaints and a way to fine companies that have more than a certain number of complaints is needed.
