Commerce Energy Group, Inc. (“Commerce Energy”) is an independent U.S. electricity and natural gas marketing company. Commerce Energy respectfully submit this opposition to the FTC’s proposed new telemarketing rule of bringing enforcement actions against telemarketers that deliver prerecorded voice messages, even when the called party has an established business relationship with the caller. We believe the current FCC rule which permits telemarketers to place prerecorded voice calls to existing customers is working well in preventing abusive telemarketing practices. We urge the Commission to allow telemarketing calls that deliver pre-recorded messages to customers with whom Commerce Energy has an established business relationship.
