SuperGoodDeals.com, Inc.

The FTC filed a complaint against SuperGoodDeals.com, Inc. and its owner, Kevin J. Lipsitz, alleging that the defendants falsely promised consumers next-day shipping of facemasks and other personal protective equipment (PPE) to deal with the coronavirus pandemic. In addition, the FTC alleged that some of the other merchandise sold through the SuperGoodDeals website were falsely advertised as “authentic” or “certified.”

Kevin Lipsitz, who defrauded consumers by falsely promising “next day” shipping of facemasks and respirators to consumers at the height of the COVID-19 pandemic, will be banned from selling personal protective equipment (PPE) and be required to turn over more than $145,000 to the FTC.

Consumer Health Benefits Association, et al.

The Federal Trade Commission is sending nearly $7 million in refunds to consumers who paid for health insurance but instead got medical discount plans pitched by Consumer Health Benefits Association (CHBA).

According to the FTC’s complaint against CHBA, related entities, and their owners, the company targeted consumers who searched online for information about affordable health insurance plans. CHBA telemarketers allegedly pitched consumers with a long list of false claims about the benefits of the discount plans, including that the plans were as widely accepted and would provide the same cost savings as legitimate health insurance companies, and also misled consumers about the company’s refund policies.

The FTC recovered almost $7 million pursuant to the terms of six final orders with defendants Guarantee Trust Life Insurance, Vantage America Solutions, Inc., Century Senior Services, Richard Holson, III, Barbara Taube, and Jeffrey Burman; Ronald and Rita Werner; John Schwartz; Louis Leo; Wendi Tow; and Consumer Health Benefits Association, National Benefits Consultants LLC, National Benefits Solutions LLC, and National Association for Americans.

Publishers Clearing House, LLC (PCH), FTC v.

As a result of a Federal Trade Commission lawsuit, Publishers Clearing House (PCH) has agreed to a proposed court order will require it to pay $18.5 million to consumers who spent money and wasted their time, and make substantial changes to how it conducts business online.

In a complaint against PCH, the FTC charges that the company uses “dark patterns” to mislead consumers about how to enter the company’s well-known sweepstakes drawings and made them believe that a purchase is necessary to win or would increase their chances of winning, and that their sweepstakes entries are incomplete even when they are not. The FTC also charges that the company has added surprise shipping and handling fees to the costs of products, misrepresented that ordering is “risk free,” used deceptive emails as part of its marketing campaign, and misrepresented its policies on selling users’ personal data to third parties prior to January 2019. Many consumers affected by these practices are older and lower-income.

The Federal Trade Commission took legal action against three ticket brokers based in New York who allegedly used automated software to illegally buy up tens of thousands of tickets for popular concerts and sporting events, then subsequently made millions of dollars reselling the tickets to fans at higher prices.

The three ticket brokers will be subject to a judgment of more than $31 million in civil penalties for violating the Better Online Ticket Sales (BOTS) Act, under a proposed settlement reached with the FTC. Due to their inability to pay, the judgment will be partially suspended, requiring them to pay $3.7 million.

This is the first case brought under the BOTS Act, which was enacted in 2016 and gives the FTC authority to take law enforcement action against individuals and companies that use bots or other means to circumvent limits on online ticket purchases.
