The Federal Trade Commission today announced the following actions.

Consent orders given final approval: Following public comment periods, the Commission has determined to issue consent orders against the following entities as final, thus making the consent orders' provisions binding on the companies.

  • The Upjohn Company, of Kalamazoo, Michigan, and Pharmacia Aktiebolag, a Swedish firm, regarding their $13.9 billion merger. The consent order is designed to preserve competition in the research and development of drugs intended to treat colorectal cancer and to assure lower prices once those drugs reach the market.   • Genetus Alexandria, Inc., of Alexandria, Virginia, its successor corporation, Galen Medical Centers, Ltd., and principal officers, George Oprean and Linda Huffman, regarding allegedly false and misleading claims Genetus made in connection with an impotence treatment. (Galen was charged as the successor or alter ego to Genetus, and was not alleged to have disseminated the challenged ads.) The consent order prohibits the respondents from misrepresenting the nature or extent of a physician's participation in any treatment procedure, the safety or efficacy of any treatment procedure and the extent to which a treatment is covered by a patient's medical insurance.
