Staff of the Federal Trade Commission, along with the co-plaintiff states, today filed an emergency motion seeking an injunction pending appeal of the U.S. District Court for the District of Columbia’s August 13 order denying the FTC’s request for a preliminary injunction to bar Arch Coal, Inc.’s acquisition of Triton Coal Company, LLC.
The emergency motion was filed under seal in the U.S. Court of Appeals for the District of Columbia Circuit, and a redacted public version is now available on the FTC’s Web site as a link to this press release. The motion also requests that the court expedite the appeal in this matter.
The FTC’s Bureau of Competition seeks to prevent business practices that restrain competition.
