Announced Actions for January 14, 1997

The Federal Trade Commission today announced the following action.

Commission action regarding petitions to reopen and modify FTC orders: Following a comment period, the FTC has ruled on a petition from the following:

• The FTC has granted the petition of The Penn Traffic Company, of Syracuse, New York, thereby reopening and modifying a 1995 consent order so as to end the firm’s obligation to divest one of its two supermarkets in Mount Carmel, Pennsylvania. This divestiture had been one of three required under the 1995 order, which was designed to restore supermarket competition allegedly injured when Penn Traffic acquired 45 stores in Pennsylvania and New York from Acme Markets, Inc. (the other two required divestitures received FTC approval). In granting the petition, the FTC said Penn Traffic had demonstrated that new entry into the Mount Carmel market by Sav-A-Lot and Wal- Mart has eliminated the need for the divestiture.
