State petition submitted to the Commission:
The Commissioner for the North Dakota Department of Banking and Financial Institutions has requested the following: That the Federal Trade Commission make a determination about how the federal Gramm-Leach-Bliley Act affects North Dakota's financial privacy law. Under Section 507 of the Gramm-Leach-Bliley Act (15 U.S.C. § 6807 (1999)), interested parties can petition the Commission for a determination as to whether a state law provides greater protection to consumers than the Gramm-Leach-Bliley Act. If a state law is inconsistent with the federal law and provides greater protection than the federal law, the federal law would not preempt the state law. The petition and related documents are available on the Commission's public record and at: http://www.ftc.gov/privacy/glbact/index.htm (Staff contact is Dorothy P. Patton, 202-326-2305.)
