The Federal Trade Commission today announced the appointments of Ann Malester as Deputy Director of the Bureau of Competition and Steven K. Bernstein as Assistant Director for Mergers I, one of the three merger shops within the Bureau. Both appointees are career FTC staff attorneys, Malester with 26 years of experience and Bernstein with 12 years. Both appointments are effective August 11, 2003.
Malester participated in numerous trials in the Bureau, including two U.S. Supreme Court cases – FTC v. Ticor Title Insurance Co. and American Medical Association v. FTC. Since 1991, she has served as the Assistant Director for Mergers I, supervising the investigation and litigation of hundreds of mergers and acquisitions during the merger wave of the 1990s. In particular, her division reviewed proposed mergers in the pharmaceutical, biotechnology, medical device, and defense and aerospace industries. Malester is a 1973 graduate of Bryn Mawr College and a 1977 honors graduate of George Washington University Law School.
Bernstein has worked on several major merger cases, especially in the pharmaceutical, defense, and aerospace industries, including Astra/Zeneca, Lockheed Martin/Loral, and Boeing/Rockwell. He received a B.B.A. in accounting from the University of Miami in 1988 and a J.D. from Northwestern University School of Law in 1991.
